HUMAN rights.

They're not humans, they're mutants, therefore when you take the law to it's ultimate extent it does not apply to them. In short, mutants have no rights under the law.

And the government is doing what it thinks is necessary to protect itself and it's citizens from a threat, and David is most definitely that! Not that he means to be really, but he is. He can't control his incredible powers, and he sometimes doesn't know where he is or what he's doing. That's inviting disaster.

Mutants are still human. They evolved from the human race and should be allowed to be treated as such, not as lab rats, and it felt inviting for them to take action against these bureaucrats who would submit them to torture and death like they most likely do to people in general whenever they see a potential problem.
