Is this rape?

If a guy is sober and gets a girl drunk in order to have sex with her, is that rape? And the girl doesn't say yes or no because she's too drunk to give or not give consent

And let's say it's her first time and she doesn't really do anything just lays there and he has sex with her

At what point exactly is someone too drunk to give consent? I think most juries would look at whether or not she she drank the alcohol of her own accord and went to bed with him willingly. If she did that then I doubt they would convict. It's hard to say though. There is a lot of pressure these days to convict men of rape without asking any questions. All a girl has to do is claim she was not conscious during the sex and he would be screwed.

It definitely sounds unethical to ply someone with alcohol just to get them to submit to sex. But I'm not sure that is rape, if the person is old enough to drink and is doing so willingly. And is alert and not passed out when sex ensues.

If your main criteria for whether you'll have sex with a drunk girl is, will I be convicted of rape by a jury, you might want to raise the bar higher.

What if the girl is not old enough to drink and the guy is? And he's the one buying her drinks with the intetion of using her for sex. Plus the girl definitely being too drunk to think straight. Thanks for the answer btw!

It's a crime to buy a minor alcohol. But it's also sometimes a crime to drink alcohol depending on the circumstances if you're a minor and you do so of your own accord. So they could both be facing criminal charges for that.

I still don't think it would be rape though, but it would definitely look a lot worse for him if she was under 21 and he knew that and continued to give her drinks regardless of that knowledge. I'd say it's definitely not rape, unless she was so incapacitated that she was literally unable to move, and therefore unable to say no.

Yes, it is always a biased and one way street with females and they are always play the victim and the male is always at fault. She wants just the same thing from him, as he does from her, but of course we can't ever taint a female as having a deviant or questionable sexual thought.

If it's two people who are both drunk and they have sex then I think that's fine but a sober man purposely getting a girl drunk so that she is not aware enough to consent to sex before he starts having sex with her, should be considered an act of rape, yes. Even if she chose to drink that can lead to her being too inebriated to decide to have sex.

The problem with this is that rape is defined as forced sex. If someone is merely drunk and not making good decisions that isn't being forced. Yes this scenario sounds unethical but that isn't enough to make something rape. This reminds me of women who want to claim rape because a man lied to them about what he does for a living or how much money he makes. That isn't what rape is.

Not being conscious enough to consent is nonconsensual sex which is rape. If you don't consider having sex with someone who hasn't agreed to have sex as rape then we're done here.

That isn't what the OP said. The OP said too drunk to think straight. There is a huge difference between having impaired judgment and being unconscious.

It's dangerous to blur the line of rape to include people who are drunk. So I'm just as annoyed with you as you are with me.

The OP never mentioned unconsciousness. There's no such thing as being too drunk to consent. We're not talking about being unconscious.

Jesus Christ man. What the hell do you think he meant? Did you just ignore that part and pretend it was talking about just drunk sex? The girl is so drunk that she is incapable of indicating in any way that she does or does not want to have sex and then the guy starts having sex with her. That's rape to most people but I'm glad you think that's totally cool, keep doing whatever you do on your dates.

I was upset about this show when it started and I assumed it would be man-hating but you know what? It's actually not and I got over it. Why are you here every day still complaining? I'm not defending rapists. But this is a slippery slope talking about having sex with girls who are drunk being rape. I definitely said it is unethical, but that doesn't mean it's rape.

That's completely inaccurate. Rape is any sexual act where consent is either not given or is not able to be given. Occasionally it's any penetrative act, but more and more are going away from that definition as it's generally overly restrictive and makes it hard for women to commit rape by that definition. If the person was drunk to the point where they couldn't consent, it's rape. They don't have to be unconscious for that to be the case. The situation that OP described would at worst be considered sexual assault, but could meet the necessary elements for rape depending on the jurisdiction that they are in.

That's not what they're talking about. They're discussing someone being too drunk to make good decisions. Like a girl getting too wasted to even stand up getting into bed with a guy and making out with him leading to sex. All seemingly consensual except for the fact that her judgment was too impaired to make good choices.
