I might be wrong on this. But wasn't the Hays Code still in effect? And shouldn't Edward G. Robinson's character be shown getting arrested?

Yes, you're right. But the producers could have convinced the "Hays Office" that Criss was paying a price for his crime, which, as explained by the crime reporter on the train, is greater than any price a judge could order.

I AGREE. THE SCENE ON THE TRAIN WITH THE REPORTERS LAYS OUT HOW THE PUNISHMENT WILL FIT THE CRIME.
