My heart really broke for Billy towards the end

The scene where he falls on his face, Ted runs him to the hospital and he has to get stitches without any sedatives was painful to watch. However, the most painful to me was towards the end. When Ted is explaining to Billy that he has to live with his mother, it almost broke my heart in two, particularly the part where Billy says, as he's fighting back tears "You're not going to tuck me in anymore are you dad?". Then as he cries he says "If I don't like it can I come home?". Oh, that was so hard to watch. The part near the end when they're making French toast and make eye contact was also really painful. I can imagine that it would have been extremely hard for Ted. As a parent you want to always be there for your child and protect them from hurt and pain but at this point, he was completely powerless to do either.

As a parent, I feel like the mother (forgot her name) was extremely selfish up until the end, that is. I just don't understand why she didn't seek joint custody. They could have come up with some type of agreement amongst themselves but I guess it wouldn't have bee much of a movie had they done that. Also, why didn't anyone ask Billy who he wanted to live with? I know he was just 6/7 but 6/7 year olds aren't exactly babies or stupid. I think that they at least have some idea of where they would rather stay and who they would rather stay with.
